Custodia Serena Platform Terms of Service

Custodia Serena provides cemetery website and operations software. Cemeteries control their own public content, legal review, privacy settings, public-search visibility, and published statements.

1. Overview

Custodia Serena provides cemetery website and operations software for cemeteries, parish cemeteries, municipal cemeteries, Christian cemeteries, Catholic cemeteries, interfaith cemeteries, and private cemetery operators. Custodia Serena does not provide legal, tax, accounting, cemetery-law, funeral-law, religious, pastoral, medical, insurance, or financial advice.

These Terms govern access to and use of Custodia Serena, including customer dashboards, public cemetery website templates, media tools, family request forms, custom-domain tools, support tickets, documentation, and related services. By creating an account, selecting a plan, using the dashboard, publishing a cemetery website, or otherwise using Custodia Serena, you agree to these Terms on behalf of yourself and, if applicable, the cemetery, parish, municipality, organization, company, or entity you represent.

2. Customer responsibility

You are responsible for all cemetery information, records, media, maps, service details, public statements, privacy notices, terms text, payment links, form wording, family communications, and legal language that you create, upload, approve, or publish through Custodia Serena.

You are responsible for reviewing public content, record visibility, memorial visibility, family access permissions, and payment workflows before publishing. You are also responsible for complying with applicable cemetery, burial, privacy, consumer-protection, records, accessibility, religious, municipal, and local operating requirements.

3. Custodia Serena's role

Custodia Serena provides software, structured fields, templates, reference text, dashboard workflows, support tools, and technical infrastructure. Custodia Serena does not certify that a customer's public website, records, privacy notice, terms notice, payment language, family access workflow, or cemetery operation satisfies any law, rule, policy, or religious requirement.

4. Accounts and users

You are responsible for safeguarding account credentials, assigning appropriate user roles, removing users who should no longer have access, and monitoring account activity. Staff and superuser access is reserved for authorized Custodia Serena personnel or platform operators.

5. Payments and external services

Custodia Serena may support Stripe, Stripe Connect, or external payment links when configured. Payment availability depends on account setup, provider rules, and the customer's configuration. Customers are responsible for prices, refunds, receipts, service terms, tax treatment, and customer communications related to cemetery payments unless a separate written agreement says otherwise.

6. Acceptable use

You may not use Custodia Serena for illegal, harmful, abusive, deceptive, privacy-invasive, spammy, malicious, or platform-damaging activity. Custodia Serena may suspend, restrict, unpublish, remove, disable, or terminate service when it reasonably believes content, activity, or configuration creates legal, security, operational, reputational, provider, family-safety, or trust-and-safety risk.

7. Content, privacy, and cookies

Customers control their own cemetery website content and are responsible for deciding what records, memorial information, photos, documents, maps, and family details are public, family-only, private, or unpublished. Custodia Serena may provide privacy and visibility tools, but the customer remains responsible for correct use.

Custodia Serena may use essential cookies, local storage, or similar technologies for login, CSRF protection, session security, language preferences, form security, fraud prevention, support workflows, and service operation. Optional analytics, embedded media, or marketing tools should only be enabled when configured and disclosed appropriately.

8. Domains and DNS

Customers may use a Custodia Serena path or connect a custom domain when supported. DNS and nameserver changes can affect existing email, websites, and other services. Customers are responsible for reviewing instructions carefully and coordinating changes with their domain or IT provider when needed.

9. Support, availability, and changes

Custodia Serena may update features, templates, security controls, documentation, pricing, plans, and provider integrations over time. We work to keep service reliable, but internet services, DNS, email, payment providers, storage providers, and hosting systems may experience outages or delays.

10. Limitation of liability

To the maximum extent permitted by law, Custodia Serena and its owners, operators, employees, contractors, vendors, and affiliates are not liable for indirect, incidental, consequential, special, punitive, exemplary, or reputational damages; data loss; downtime; domain misconfiguration; provider outages; legal noncompliance; third-party claims; or customer content, even if advised of the possibility of such damages.

11. Indemnity

You agree to defend, indemnify, and hold harmless Custodia Serena and its owners, operators, employees, contractors, vendors, and affiliates from claims, demands, liabilities, losses, damages, costs, and expenses arising from or related to your account, cemetery website, content, media, domains, records, payments, forms, exports, translations, legal text, violation of these Terms, violation of law, or infringement of third-party rights.

12. Contact

Questions, support requests, abuse reports, copyright concerns, privacy concerns, security concerns, or unlawful-content reports should be submitted through the Custodia Serena contact, support, or abuse-report process.
